Statute of Limitations: You agree that any cause of action must commence within one (1) year after the cause of action accrues; otherwise, it is permanently barred.
6. INDEMNIFICATION & RELEASE
You agree to indemnify and hold us harmless from any claims arising from your breach of these terms. You hereby release and discharge the Company and its agents from any and all claims, known or unknown, connected with your use of the Service.

8. ARBITRATION AGREEMENT
Any dispute relating to these Terms or the Service shall be resolved exclusively through final and binding arbitration administered by JAMS (under its Consumer-Related Dispute rules) or the American Arbitration Association (AAA). You waive your right to a jury trial or a state/federal judge.
9. CLASS ACTION WAIVER
YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
10. SMALL CLAIMS EXCEPTION
Notwithstanding Section 8, you may assert claims in small claims court if your claims qualify and the total amount in dispute is less than $1,000.00.
11. GOVERNING LAW & SEVERABILITY
These terms are governed by the laws of the State of Delaware. If any part of Section 8 (Arbitration) or Section 9 (Class Action Waiver) is found invalid, the entirety of those sections shall be null and void, and jurisdiction shall reside exclusively in the state and federal courts of Delaware.
